Per section 455.020, RSMo any person who has been a victim of domestic violence committed by a past or present family or household member, or who has been the victim of stalking or sexual assault may file a petition in the circuit court where petitioner resides, where the domestic violence occurred or where the respondent may be served requesting relief from the domestic violence, stalking, or sexual assault committed by the respondent.
What is an ex parte?
An ex parte is a temporary order of protection granted to the petitioner until hearing can be held.
Who can file for an ex parte?
Any adult or child who has been subject to abuse by a present or former family or household member, or who has been the victim of stalking, may seek relief. (The parent, guardian, or court-appointed special advocate needs to fill out the paper work for minor.)
